These Terms of Service (the “Terms”) constitute a legally binding agreement (the “Agreement”) between you and Trade Smart Company Ltd (as defined below) which governs your access to the Rwanda Homes website and your use of this website, including its subdomains and all other sites through which Services of Rwanda Homes are provided (collectively, the “Site”), as well as all associated services (collectively, “Trade Smart Company Services”). The Rwanda Homes Website and Services are collectively referred to hereafter as the “Rwanda Homes Platform”. Our Owner / Agent Warranty Policy, Traveler Refund Policy, Non-Discrimination Policy and other Policies applicable to your use of the Rwanda Homes Platform are incorporated by reference into this Agreement.

The terms “Rwanda Homes” “we” “our” “ours” used in the present conditions refer to the company Trade Smart Company Ltd with which you enter into a contract. Your procuring entity will generally be determined by your Country of Residence. Your “Country of Residence” is the jurisdiction associated with your Rwanda Homes Account as you have specifically selected or as determined by Rwanda Homes’ evaluation of your home using various data attributes associated with your Rwanda Homes Account.

Eligibility, Use of the Rwanda Homes Platform, Audit of Members

You must be at least 18 years old and have the ability to sign a contract to get access on the Rwanda Homes Platform, use it or create a Rwanda Homes Account. By accessing or using the Rwanda Homes Platform, you certify that you are at least 18 years old and have the ability and the right to sign a contract.
Rwanda Homes may submit access and use of the Rwanda Homes Platform or to certain areas or functionalities of the Rwanda Homes Platform, subject to certain conditions or requirements, such as submission to a verification procedure, satisfaction of certain quality criteria and eligibility, the achievement of certain rating or comment thresholds, or a Member’s reservation and cancellation history

Creation of an account

You must create an account (the “Rwanda Homes Account”) to access and use certain features of the Rwanda Homes Platform, such as posting an Announcement or making a reservation. If you create a Rwanda Homes Account for a corporation or other legal person, you certify that you have the power to legally bind this legal person and to grant us all the authorizations and licenses provided for in these Terms.
You must enter accurate, up-to-date and complete information during the registration process and keep the information of your Rwanda Homes Account as well as the information on the public page of your profile in your Rwanda Homes Account.
You are prohibited from creating multiple Rwanda Homes Accounts unless Rwanda Homes allows you to do so. You may not assign or otherwise transfer your Rwanda Homes Account to another party.

Service charge

Rwanda Homes may charge a fee to Hosts (the “Owner / Agent Fees”) and / or Travelers (the “Traveler Fees”) (collectively, the “Service Fee”) in consideration for the use of the Rwanda Homes Platform.
The applicable Service Fees (including any applicable Taxes) are communicated to the Host before he or she posts an Announcement or to the Traveler before it reserves. Rwanda Homes reserves the right to change the Service Fees at any time and will notify Members of this within a reasonable period of time before the new rates become effective.
You are required to pay the Service Fees due to Rwanda Homes. The applicable Service Fees (including any applicable Taxes) are collected by Rwanda Homes Payments. Rwanda Homes Payments will deduct any Owner / Agent Fees from the posted Price before remitting the payment to the Owner / Agent. All Traveler Expenses are included in Total Fees collected by Rwanda Homes Payments. Unless otherwise stated on the Rwanda Homes Platform, Service Fees are not refundable.

Special conditions for the Owner / Agent

When you create an Ad on the Rwanda Homes Platform, you must (i) provide complete and accurate information about your Owner / Agent Service (such as housing description, location and availability dates), (ii) identify deficiencies, restrictions (such as by-laws) and applicable conditions (such as minimum age, aptitudes or physical condition required to an Experience) and (iii) provide other relevant information requested by Rwanda Homes. It is your responsibility to keep your Ad information up-to-date (including availability dates).
You are solely responsible for setting the price (applicable taxes included, as well as any other expenses such as cleaning fees) for your Ad (“Displayed Price”). Once a Traveler has booked, you cannot ask for a higher price than the one in the booking request.
When you accept or have pre-approved a booking request from a Traveler, you enter into a legally binding agreement with that Traveler and you are then required to provide the Service / Services offered by the Owner / Agent to the Traveler in the manner described in your Ad on the date of the reservation request. You also agree to pay the applicable Owner / Agent Fees and any applicable Taxes.

Special conditions for the Traveler.

Subject to compliance with all conditions defined by Rwanda Homes and / or Owner / Agent (such as submission to a verification procedure), you may book a proposed Accommodation on the Rwanda Homes Platform by following the appropriate booking procedure. All applicable fees, including the posted Price, the Security Deposit (if any), the Traveler’s Fees and all applicable taxes (collectively, the “Total Fees”) will be shown to you prior to booking. You agree to pay the Total Fee for any reservation requested with your Rwanda Homes Account.
Upon receipt of a booking confirmation from Rwanda Homes, a legally binding agreement is established between you and your Owner / Agent, subject to the applicable Additional Owner / Agent terms, including, without limitation, the applicable cancellation terms and conditions, the rules and restrictions specified in the Announcement. Rwanda Homes Payments will recover Total Fees at the time of the reservation request or upon confirmation from the Owner / Agent in accordance with the Terms of Payment. For some reservations, Travelers may be required to pay or have the option to pay in multiple installments.
If you book an Owner / Agent Service on behalf of additional travelers, you must verify that each of them complies with the conditions defined by the Owner / Agent, and is aware of these Terms and other conditions, rules and restrictions by the Owner / Agent and accepts them. If you make a reservation for an additional traveler who is a minor, you represent and warrant that you are legally entitled to act on behalf of the minor. In order to participate in an Owner / Agent Service, minors must be accompanied by an adult who is responsible for it.
You understand that a confirmed reservation of Accommodation (the “Accommodation Reservation”) constitutes a limited authorization granted to you by the Owner / Agent to enter, occupy and enjoy the Accommodation during the length of your stay, during which time the Owner / Agent (subject to applicable law) retains the right to reinstate the Accommodation, in accordance with the agreement you have with the Owner / Agent.

Booking of the apartment

  • Your apartment will be booked after paying a deposit or set amount before occupying the accommodation.
  • This pre-payment must be done through Credit card, Paypal, Bank transfer or cash.
  • This pre-payment is not refundable in case of cancellation on the same day of arrival.
  • Your reservation will not be confirmed until Rwanda Homes has received the prepayment of the rental deposit and you have received a confirmation email from Rwanda Homes within 24 hours during business days or 48 hours hours on weekends or holidays.
  • Please note that if you make a reservation for the same day, check-in will be done from 17:00.
  • This confirmation e-mail contains all the details of the booking: apartment address, contact information, balance of payment on arrival and other practical information of arrival and departure.
  • On your arrival, you must pay the rest of the rental and the deposit. You will be informed on the mode of payment concretization with the email of your booking confirmation

Payment details

  • Please check your payment terms in the confirmation email.
  • Exceptionally, this payment can be made by bank transfer with the following conditions:
    o We receive the net amount in our bank  before your arrival.
    o We have confirmed the receipt of this amount with a receipt.
  • For some villas, there is a specific payment method. Please consult the apartment that interesses you the most, for more details.

City Tax

City tax per person per night is included in the price.

Cancellation

  • Any cancellation or change must be done by the Rwanda Homes platform. Cancellations or changes by phone will not be accepted.
  • Pre-payment will not be refunded in case of cancellation within 24 hours before your arrival.
  • If you cancel within 24 hours before arrival, or if you do not show up, you will be charged the full amount of the reservation.
  • If the customer decides to change the dates of his stay or change apartment, the change will take effect of a new reservation and will be subject to the cancellation conditions mentioned above.
    Security Deposit
    On your arrival, we may ask you to give us a deposit as a guarantee for the apartment and its contents. This deposit must be paid in cash or by credit card. Please refer to your confirmation email to find out how you should adjust it.

o Cash: All deposits paid in cash will be refunded, upon departure, after inspection of the apartment by the owner if it is not damaged.
o Credit card: All deposits paid by credit card will be refunded on the same card the day after departure if the apartment is not damaged, (for some credit cards it can take from 4 to 7 days from departure for refund).
Please note that by accepting our terms and conditions, you agree that any damages that you or your accompanying persons may cause will be deducted from this deposit. You will also be liable if the damages exceed the amount thereof.

Arrival and departure
Preparation for the arrival

o Please make sure that you have sent us your arrival time so that we can organize your check-in and keep your contact person informed of any delays or changes.
o We will provide your contact person with your phone number and email address in case he needs to contact you about your arrival time. You can send us this information by e-mail to the following address: info@Rwandahomes.com or by calling us on +250 785 231 064
o Your confirmation email clearly tells you where to find your contact person on the day of your arrival.
The day of arrival

o You must call on arrival at the airport (or an hour before your arrival if you are traveling by car). You will then be told if you:
-Must go to our office, where you will meet our team of “check-in” who will give you the keys of the apartment, give you explanations on its operation and will indicate the way to get there.
– Must go directly to the apartment where you will be received by your contact person who will give you the keys and explain how it works.
o The apartments are normally available from 3pm but we always try to make early entries if needed. It is extremely important that your arrival time be updated. Without this information, you may have to wait for your contact person and this will delay your check-in.
o Please note that there is an extra charge of 30 USD for arrivals after 21:00.

Your departure
• You agree to leave the Accommodation not later than the occupancy time specified by the Owner / Agent in the Announcement or at such other time as may be mutually agreed between you and the Owner / Agent.
• If you need a late departure, ask at your arrival if it is possible. We will try to arrange it if it is compatible with the arrival of the following tenants.
• The day of your departure, we will ask you to leave the apartment tidy, dustbins out. Please leave ALL sets of keys on the table and slam the door, making sure you have not forgotten anything and that the main door of the building is not locked.
• If you tell us well in advance, we can book a taxi to take you to the airport.

Cleaning the apartment
• The apartments are fully cleaned before the arrival of each guest.
• When leaving, we ask you to leave it in good conditions with the dustbins out. If this is not respected, we will charge you an additional cleaning fee.

Number and identity of occupants
• The client must inform Rwanda Homes of the number of people who will reside in the apartment.
• Except for Rwanda Homes exceptional permission, only the persons specified in the contract may use the apartment.
• The number of people cannot exceed the maximum number of people who can accommodate the apartment, with the exception of children under four years.
• Pets will only be allowed if the agreement has been given in advance.
• If these conditions are not respected, Rwanda Homes may require the tenant to leave the premises. No refund or compensation may be required by the tenant.

Behavior in the apartments
• Please read the Owner / Agent General Terms and Conditions regarding noise, loud music and parties. Guests staying in Rwanda Homes’ apartments should know that if loud music or a party is heard by the neighbors and that they call the police, we will proceed to the immediate evacuation of all occupants regardless of the time of the day. Day or night.
• We appreciate your cooperation in this area and hope you understand that these rules are necessary because our apartments are located in residential buildings where people get up every morning to work. Their nocturnal rest must be respected.
• We will also ask you to sign these rules upon your arrival and that your behavior is correct and respectful. If this is not respected, Rwanda Homes reserves the right to ask you to leave the apartment and this will also result in the loss of the prepaid rental and the deposit.
• When booking an apartment with Rwanda Homes, you agree to these terms and we ask that you comply with them. We will also ask you to sign these rules upon your arrival.

Responsibility
• Neither Rwanda Homes nor the owner can be held responsible for damage and / or incidents that occur during the tenant’s stay in the apartment: damage, insurance, loss caused by fire or theft, delinquency.
• In the event that the rules mentioned above are not respected, Rwanda Homes reserves the right to require tenants to vacate the premises. No refunds or compensation may be required by Rwanda Homes

Privacy Policy

This Privacy Policy governs the manner in which Rwanda Homes website collects, uses, maintains and discloses information collected from users (each, a “User”) of the http://www.rwandahomes.com/ website (“Site”). This privacy policy applies to the Site and all products and services offered by Rwanda homes

Personal identification information

We may collect personal identification information from Users in a variety of ways in connection with activities, services, features or resources we make available on our Site.. Users may visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Web browser cookies

Our Site may use “cookies” to enhance User experience. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

How we protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

Sharing your personal information

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

Changes to this privacy policy

Rwanda Homes has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your acceptance of these terms

By using this Site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
